The EU’s non-compliance with the Aarhus Convention: A brief history

The European Union has been found non-compliant with the Aarhus Convention in two ongoing cases. It’s refusal to fully endorse non-compliance findings in 2017 and 2021 set a precedent for delaying accountability, undermining its credibility as a defender of the rule of law. Given slow legislative processes, it is unlikely the EU will resolve these issues before the 2025 review, risking further damage to its international reputation.
