The ruling sends a strong message to nine other Member States that have been issued final warnings by the European Commission.<\/h4>\n<p><span style=\"font-weight: 400;\">The nine other countries facing similar action are: the<\/span><b> Czech Republic, Germany, Spain, France, Italy, Hungary, Romania, Slovakia and the United Kingdom<\/b>, which<span style=\"font-weight: 400;\">\u00a0could all be sent to court next month.<\/span><\/p>\n<p><b>Margherita Tolotto, EEB Policy Officer <\/b><span style=\"font-weight: 400;\">said:<\/span><\/p>\n<blockquote><p><i><span style=\"font-weight: 400;\">\u201cThere\u2019s a toxic bloc of EU countries that are consistently breaching air quality laws and have been far too slow to clean up their air. This ruling in not just about Poland; it should serve as a warning to other governments that there are consequences for inaction on air pollution. The European Commission has been very clear that a Europe that cares about its citizens cannot ignore this invisible killer. We expect other governments will be sent to court next month.\u201d<\/span><\/i><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Last month the European Commission said: \u201c<\/span><a href=\"https:\/\/ec.europa.eu\/commission\/commissioners\/2014-2019\/vella\/blog\/europe-protects-cannot-sit-400000-europeans-die-poor-air-quality-each-year_en\"><span style=\"font-weight: 400;\">A Europe that protects cannot sit by as 400,000 Europeans die from poor air quality each year<\/span><\/a><span style=\"font-weight: 400;\">\u201d. After many years of breaches and inaction, additional<\/span> information sent since the January meeting is unlikely to be significant enough to influence expert advice.<\/p>\n<p>The EEB has previously warned that\u00a0<a href=\"http:\/\/eeb.org\/fr\/national-inaction-and-commission-delays-undermining-eu-air-quality-protections\/\">Commission delays and national inaction were undermining EU air quality law<\/a>s.<\/p>\n<p>The 28 European Commissioners will have a final vote on whether to send cases to court, but they appear to be united in their desire to protect European citizens<span style=\"font-weight: 400;\"> from dangerous levels of air pollution. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Environment Commissioner Karmenu Vella has clearly stated that \u201cinaction has consequences\u201d and that \u201cwe can delay no more\u201d &#8211; heavily <\/span><a href=\"https:\/\/metamag.org\/2018\/02\/01\/european-commission-tells-nine-member-states-well-see-you-in-court\/\"><span style=\"font-weight: 400;\">hinting that additional cases will be sent to the court<\/span><\/a><span style=\"font-weight: 400;\"> at the next opportunity, likely to be around the second week of March 2018.<\/span><\/p>\n<p><strong>\u00a0Commenting on the situation in Poland, Tolotto said:<\/strong><\/p>\n<blockquote><p>&#8220;Today&#8217;s ruling is a victory of people across Poland because their government will now have to take its responsibility by publishing a new and more effective plan to reduce emissions and ensure clean air. Just this week, ClientEarth won a case against the UK government and a federal court in Germany is set to rule later today on whether diesel cars can be banned in German cities. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">But campaign groups do not always have the resources to fight cases in the national courts and the European Commission is responsible for ensuring European laws are properly implemented. By taking national governments to court, they can ensure the people all over Europe enjoy their right to clean and healthy air. <\/span><\/p>\n<h4>What have other countries done, or said they will do, to improve their air?<\/h4>\n<p><span style=\"font-weight: 400;\">Some governments have been more transparent than others about their plans. <\/span><\/p>\n<p><b>Germany <\/b><span style=\"font-weight: 400;\">made the news when it emerged it was investigating the introduction of <\/span><b>free public transport<\/b><span style=\"font-weight: 400;\"> and the retrofitting of dirty diesel cars. However, the German plans make<\/span><b> no mention of coal or lignite power stations<\/b><span style=\"font-weight: 400;\">, which are the largest single-sources of air pollution in Europe. <\/span><\/p>\n<p><b>France <\/b><span style=\"font-weight: 400;\">repeated promises made in May 2017 including supporting the use of <\/span><b>electric cars<\/b><span style=\"font-weight: 400;\"> and setting-up zones where trafic will be limited. Campaigners have said these measures are clearly inadequate. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>Slovakia <\/b><span style=\"font-weight: 400;\">has provided detailed information about the <\/span><b>EU funds <\/b><span style=\"font-weight: 400;\">being invested in measures to tackle air pollution and, unlike Germany, made explicit mention of the need to address pollution from large combustion plants like coal-fired power stations. <\/span><\/p>\n<h4>What should governments do to improve their air?<\/h4>\n<p><span style=\"font-weight: 400;\">Serious action is required to reduce the environmental impact of <\/span><b>energy, food and transport<\/b><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Energy systems need to be based on <\/span><b>clean, renewable energy<\/b><span style=\"font-weight: 400;\"> that can deliver commitments made under the Paris climate agreement. <\/span><b>Reducing wasted energy<\/b><span style=\"font-weight: 400;\"> through improved efficiency and better designed products will also be essential. <\/span><a href=\"http:\/\/eeb.org\/fr\/meps-back-energy-savings-to-rescue-europes-climate-policy\/\"><span style=\"font-weight: 400;\">Higher EU targets are required<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><b>Europe must move beyond coal before 2030<\/b><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">We also need a <\/span><b>sustainable food system<\/b><span style=\"font-weight: 400;\"> with steps taken to reduce emissions at all stages from production to consumption. A <\/span><b>reformed common agricultural policy<\/b><span style=\"font-weight: 400;\"> must work in harmony with nature, not against it. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Emissions from transport must be addressed, cutting subsidies for <\/span><b>diesel cars <\/b><span style=\"font-weight: 400;\">and taking the most polluting vehicles off of our streets. Effort must be made to encourage a move to <\/span><b>zero-emissions transport <\/b><span style=\"font-weight: 400;\">and to develop <\/span><b>improved infrastructure<\/b><span style=\"font-weight: 400;\"> that\u2019s fit for the 21st century. <\/span><\/p>\n<h4>What kind of pollution are we talking about?<\/h4>\n<p><span style=\"font-weight: 400;\">The case against <\/span><b>Poland<\/b><span style=\"font-weight: 400;\">, and infringement proceedings against the <\/span><b>Czech Republic, France, Italy, Hungary <\/b><span style=\"font-weight: 400;\">and <\/span><b>Slovakia<\/b><span style=\"font-weight: 400;\">, are related to breaches of limits for <\/span><b>airborne particulate matter, called PM10<\/b><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cases again Germany, France, Italy, Spain, Romania and the United Kingdom concern <\/span><b>nitrogen dioxide<\/b><span style=\"font-weight: 400;\"> pollution, or <\/span><b>NO2<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h4>What causes this pollution?<\/h4>\n<p><b>PM10 <\/b><span style=\"font-weight: 400;\">pollution can come into the air from various sources including motor vehicles, burning substances to heat homes, burning coal for energy, construction sites, agriculture and industry.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Poland, the burning of various fuels to heat homes is responsible for much of the particulate matter in towns and cities, but large-scale industry, industrial agriculture and coal-fired power plants provide a baseload of air pollution across Europe. <\/span><\/p>\n<p><b>NO2 <\/b><span style=\"font-weight: 400;\">pollution is especially linked to dirty diesel cars but is also emitted in large quantities by industry and coal-fired power stations.<\/span><\/p>\n<h4>What are its effects?<\/h4>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"http:\/\/www.who.int\/mediacentre\/factsheets\/fs313\/en\/\"><span style=\"font-weight: 400;\">World Health Organisation<\/span><\/a><span style=\"font-weight: 400;\"> provides the following summaries:<\/span><\/p>\n<p><b>PM10<\/b><span style=\"font-weight: 400;\">: <\/span><i><span style=\"font-weight: 400;\">\u201cThere is a close, quantitative relationship between exposure to high concentrations of small particulates (PM10 and PM2.5) and increased mortality or morbidity, both daily and over time. Conversely, when concentrations of small and fine particulates are reduced, related mortality will also go down \u2013 presuming other factors remain the same. This allows policymakers to project the population health improvements that could be expected if particulate air pollution is reduced.\u201d<\/span><\/i><\/p>\n<p><b>NO2<\/b><span style=\"font-weight: 400;\">:\u00a0<\/span><i><span style=\"font-weight: 400;\">Epidemiological studies have shown that symptoms of bronchitis in asthmatic children increase in association with long-term exposure to NO2.
